Please read these Terms & Conditions (“Terms”) carefully before using the website located at https://partystation.fun/ (the “Site”) operated by Party Station (“we”, “us”, “our”). By accessing or placing an order through the Site, you (“you”, “your”, “Customer”) agree to be bound by these Terms.

1. Services and Products

1.1 We provide party‐supplies, including but not limited to balloons (arches, columns, characters, custom structures), tableware, décor, props, and custom installation services (“Products/Services”).
1.2 Catalogue images, descriptions, features or pricing are subject to change without notice. We make reasonable efforts to keep Product/Service information accurate, but cannot guarantee error-free.
1.3 Custom items (including custom banners, backdrops, printed items, personalized balloons, special installation jobs) require your prior approval of proofs or quotes and are final sale unless otherwise stated.

2. Order Acceptance & Pricing

2.1 Your order constitutes an offer to purchase, subject to acceptance by us. We may refuse or cancel an order for any reason (stock unavailability, pricing error, shipping restrictions, etc.).
2.2 All prices are listed in [USD] unless otherwise noted. Shipping, delivery, installation, taxes and other fees may apply and will be added at checkout or through our quote process.
2.3 We reserve the right to correct any errors or omissions, including after you submit your order.

3. Payment

3.1 Payment must be made at the time of ordering (or per the quote/contracted schedule for Services) unless otherwise agreed in writing.
3.2 We accept all major credit/debit cards, cash, tap-to-pay, Apple Pay/Google Pay, and approved house accounts for qualified organizations.
3.3 For Services requiring onsite installation or rental equipment (e.g., inflated balloon features), a deposit may be required. Cancellation or rescheduling may incur fees (see Section 8).

4. Shipping, Delivery & Installation

4.1 Non-inflated, shippable items may be shipped nationwide (subject to carrier terms). Inflated balloons or on-site installations are available for local delivery/pick-up only.
4.2 Delivery dates/times provided are estimates only. We are not liable for delays due to carrier or external factors (weather, acts of God, etc.).
4.3 For installation services, you must provide suitable access, power, space, and conditions for safe setup. We reserve the right to refuse installation or charge additional fees if onsite conditions are unsuitable.
4.4 Title and risk of loss for shipped Products pass to you when we deliver to the carrier or you pick up in-store. For installed Services, risk shifts upon completion of installation.

5. Returns, Exchanges & Refunds

5.1 Non-custom, unopened and unused Products may be returned within [14/30] days of purchase with receipt/proof of purchase, subject to our return authorization process.
5.2 Custom items (e.g., personalized banners, printed favor bags, inflated balloons) and Services are final sale and non-returnable/un-refundable unless otherwise stated.
5.3 All returns must be in original condition and packaging. You are responsible for return shipping unless authorized.
5.4 We reserve the right to refuse a return or impose a restocking fee when appropriate.

6. Product/Service Use & Safety

6.1 You agree to use Products (especially balloons, helium tanks, arches) in accordance with the instructions and safety guidelines we provide.
6.2 Helium tanks must be handled by competent adults, kept upright, and never inhaled. We are not liable for misuse.
6.3 Outdoor use of balloon installations may be subject to weather exposure; float times and durability vary by conditions (see our FAQ). We disclaim liability for outcomes affected by extreme conditions.

7. Accuracy & Intellectual Property

7.1 All content on the Site (text, images, logos, designs) is our intellectual property or used with permission. You may not reproduce or use our content for commercial purposes without express written permission.
7.2 You represent that any artwork or text you submit for custom items is your own or that you have the rights to use it, and you indemnify us for claims arising from use of your submitted materials.
7.3 We make no guarantee that Products or Services will exactly match the colours, materials or dimensions shown online; minor variation is expected.

8. Cancellations & Changes

8.1 For standard Products: you may cancel your order before it has shipped; once shipped or picked up, the standard return policy applies.
8.2 For custom Products or Services: cancellation may require full payment or incur a cancellation fee because costs are committed once you approve.
8.3 For installation Services: rescheduling may be permitted subject to availability and may incur additional fees; last-minute cancellations may forfeit deposit or incur full charge.

9. Limitation of Liability & Disclaimer of Warranties

9.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR LIABILITY IS LIMITED TO THE PURCHASE PRICE PAID FOR THE PRODUCT OR SERVICE.
9.2 WE MAKE NO WARRANTY THAT THE SITE, PRODUCTS OR SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9.3 EXCEPT AS REQUIRED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
9.4 We are not liable for indirect, incidental, special or consequential damages (lost profits, loss of data, etc.), even if advised of the possibility.

10. Indemnification

You agree to indemnify, defend and hold us harmless from any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys’ fees) arising out of:

your breach of these Terms;

your violation of any law, your misuse of the Site or Products/Services;

your submission of artwork or materials you don’t have rights to;

your negligence or willful misconduct.

11. Governing Law & Dispute Resolution

11.1 These Terms and any dispute shall be governed by and construed under the laws of the State of Maryland (or your applicable province/state).
11.2 Any dispute arising from or relating to these Terms shall be resolved exclusively in the state or federal courts located in [insert County], Maryland and you consent to personal jurisdiction there.
11.3 If any provision is held invalid or unenforceable, that provision will be severed and the remainder of the Terms will remain in full effect.

12. Modifications to Terms

13. Miscellaneous

13.2 No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
13.3 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign without restriction.
13.4 Force Majeure: We are not liable for any delay or failure in performance resulting from causes beyond our reasonable control (natural disasters, strikes, acts of government, etc.).
13.5 Headings: Section headings are for convenience and do not affect interpretation.
